Introduction

Welcome to TQMTours.com (“Website”). These Terms of Service (“Terms”) govern your use of our Website and the services provided by TQM Tours LTD (“TQM Tours,” “we,” “us,” or “our”). By accessing or using the Website, you agree to these Terms. If you do not agree, please do not use the Website.

1. Services Provided

TQM Tours LTD operates solely as an intermediary platform connecting customers (“you,” “your”) with independent third-party drivers, guides, and transportation providers (“Service Providers”) who conduct the tours.

TQM Tours does not own, operate, or control any vehicles, nor does it employ the Service Providers. We facilitate bookings and provide information, but all transportation and tour services are rendered independently by Service Providers.

2. Assumption of Risk

By booking or participating in a tour, you acknowledge and accept that travel, transportation, and tour participation involve inherent risks — including but not limited to accidents, illness, property damage, personal injury, and death. You voluntarily assume all such risks and agree that TQM Tours LTD shall not be liable for any losses, injuries, or damages arising from participation in any tour, whether caused by negligence or otherwise.

3. Limitation of Liability

a. Independent Providers: All tours and transportation are provided by independent Service Providers who are not agents, employees, or representatives of TQM Tours LTD.
b. No Operation of Vehicles: TQM Tours LTD does not operate, own, or maintain any vehicles, nor do we control the operations, maintenance, or safety standards of third-party providers.
c. No Responsibility for Accidents or Deaths: TQM Tours LTD shall not be held liable for any accidents, injuries, illnesses, delays, property loss, or deaths that occur during or as a result of participation in any tour.
d. Insurance: While Service Providers are expected to carry commercial insurance, TQM Tours LTD does not regularly verify or guarantee the validity of such coverage. Travelers are encouraged to obtain their own travel or medical insurance prior to participating.

4. Force Majeure

TQM Tours LTD shall not be responsible for delays, changes, or cancellations resulting from events beyond its control, including but not limited to weather conditions, acts of God, natural disasters, labor disputes, civil unrest, government actions, or mechanical failures.

5. Cancellation Policy

All bookings are subject to the specific cancellation terms outlined on each tour page and in your confirmation email.

General Tours: Cancellations made 72 hours or more before the scheduled start time may qualify for a refund, minus any applicable processing fees. Cancellations made less than 72 hours before the scheduled start time are non-refundable.
Train Tours (José Cuervo Express & Tequila Express): These tours are strictly non-refundable in accordance with the policies of José Cuervo and Tequila Express. No exceptions will be made once booking is confirmed.
Provider or Weather Cancellations: TQM Tours LTD reserves the right to cancel or reschedule tours due to Service Provider unavailability or unsafe conditions. In such cases, a full refund or rescheduling option will be offered, subject to availability.

6. Customer Responsibilities

You are responsible for confirming the accuracy of your booking details and reviewing the Service Provider’s terms.
You must comply with all local laws, regulations, and safety instructions during the tour.
You are responsible for any damages or additional costs you cause during participation.

7. Additional Participants

If you plan to bring additional participants, you must notify TQM Tours LTD at least 24 hours before the tour. Failure to do so may result in additional charges or the inability to accommodate your group.

8. Indemnification

You agree to indemnify, defend, and hold harmless TQM Tours LTD, its affiliates, officers, employees, and agents from any and all claims, damages, losses, or liabilities arising from:

Your participation in a tour,
Actions or omissions by any Service Provider, or
Your breach of these Terms.

9. Jurisdiction and International Operations

TQM Tours LTD is registered in Illinois, USA, and facilitates bookings for tours that occur in Mexico.

All tours are conducted by licensed, independent Mexican Service Providers and are subject to Mexican laws and regulations.
TQM Tours LTD operates strictly as a U.S.-based booking intermediary and assumes no operational responsibility for tours conducted abroad.
Any legal claims or disputes relating to incidents occurring in Mexico shall be governed by Mexican law and handled by the appropriate authorities there.

10. Intellectual Property

All content on the Website—including text, logos, graphics, photos, and videos—is owned by TQM Tours LTD or its licensors. Unauthorized use or reproduction is prohibited.

11. Payment and Processing

All payments are securely processed through trusted third-party providers (e.g., Stripe, PayPal). TQM Tours LTD does not store or have access to full credit card information. Any payment disputes must be handled directly through your financial institution.

12. Photography and Content Use

By participating in a tour, you grant TQM Tours LTD permission to use photos, videos, or testimonials from your experience for promotional purposes unless you notify us in writing before the tour.

13. Travel and Safety Responsibilities

You are responsible for ensuring you have valid travel documents and comply with all local safety and health regulations in Mexico. TQM Tours LTD is not responsible for entry denials, visa issues, or local health-related restrictions.

14. Termination

TQM Tours LTD may suspend or terminate your access to the Website for behavior that violates these Terms or applicable laws.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Illinois, USA, without regard to conflicts of law. Any disputes shall be resolved through binding arbitration in Chicago, Illinois, under the rules of the American Arbitration Association. You waive the right to participate in a class action or jury trial.
